Court Orders Mensa Otabil's ICGC To Pay Damages Of Ghc30,000 For Noise Pollution

A good precedent has been set by an Accra High Court─and trust me, people will now be bold to sue a lot of churches for noise pollution and nuisance.

One Mrs Patricia Bannerman and Dr Elizabeth Masopeh took Dr Mensa Otabil’s ICGC and one other church on and slapped them with a lawsuit for noise pollution and nuisance─and thanks to the Almighty God, they got the needed results.

The Accra High Court presided over by Her Ladyship Justice Novisi Afua Aryene “awarded damages and cost against International Central Gospel Church (ICGC) and Cross Road Community Church all in Hatso for nuisance”.

Her Ladyship Justice Novisi Afua Aryene, ordered each church to pay damages of Ghc20,000 and a cost of Ghc10,000 to the plaintiffs (Mrs Patricia Bannerman and Dr Elizabeth Masopeh).

The court also ordered the Municipal Chief Executive Officer of Abokobi to pay damages of Ghc20,000 “to the plaintiffs for reckless disregard of the interests and rights of plaintiffs for the quiet enjoyment of their properties”.

The court after thorough investigations found out that the plaintiffs’ complaint about “loud singing, clapping and drumming accompanied by electronic musical instruments and loud prayers both day and night” amounted to nuisance.

In all, the bold plaintiffs are bagging home over Ghc50,000 for doing the right thing by dragging these two churches to court for noise pollution and nuisance.
